Chirp — Terms of Service

1. Parties and scope
These Terms of Service form a contract between any individual (“User”) who downloads, installs, or uses the Chirp mobile application (“App”) and the developer Özer Subaşı. By using the App you agree to these Terms.
2. The service
Chirp is a mobile app that helps families track baby care — feedings, sleep, diapers, measurements, milestones — together. The service is offered in tiers:
- Free tier: Core tracking and limited family sharing.
- Plus subscription: AI sleep prediction, voice logging, advanced reports.
- Premium subscription: Plus + AI weekly summaries + unlimited family members.
3. Account and age
- You must be 18 or older to create an account.
- Accounts are created via Sign in with Apple.
- You are responsible for the security of your account and for all activity under it.
4. Not medical advice
IMPORTANT — MEDICAL DISCLAIMER: Chirp does not provide medical advice, diagnosis, or treatment. All AI-generated content (sleep predictions, weekly summaries, insights, etc.) is for informational purposes only and is not a substitute for professional medical judgment.
For any concern about your baby’s health, consult your pediatrician, midwife, or other qualified health professional. In emergencies, call your local emergency number (e.g., 911 in the US, 112 in the EU/Türkiye).
The App’s vaccine schedules are based on the published programs of national health authorities; final vaccination decisions are between you and your pediatrician.
5. Acceptable use
You may not:
- Use the App for unlawful purposes
- Access another user’s account without permission
- Send automated requests beyond reasonable use
- Reverse-engineer, circumvent security, or attempt to interfere with the App
- Upload harmful content (malware, harassment, hate speech, etc.)
We may suspend or terminate your account without notice for violations.
6. Subscriptions, fees, cancellation
- Subscription prices in the App match Apple App Store pricing per
docs/IAP_PRODUCTS.md. - Apple processes all payments through App Store Connect; we never see your card.
- First week free trial: New subscriptions start with a 7-day free trial. If you do not cancel at least 24 hours before the trial ends, the subscription auto-renews.
- Auto-renewal: Your subscription renews 24 hours before the period ends and your account is charged for a new period.
- Cancel: Cancel any time on your iPhone via Settings → Apple ID → Subscriptions. You keep Plus/Premium features until the current period ends.
- Refunds: Refund requests are handled by Apple at https://reportaproblem.apple.com. Apple’s decision is final.
7. AI features
- AI outputs (sleep predictions, reports, voice-note interpretations) are produced via third-party models (Anthropic, OpenAI).
- Outputs are probabilistic and not guaranteed.
- AI output must not be used as a basis for any medical decision (see §4).
- The availability and accuracy of these features may change over time.
8. Your content
- Photos, audio, notes, and logs you upload are yours.
- You grant us the technical license needed to operate the service (storage, AI processing, family-internal sharing). This license ends when you delete your account.
- We do not use your content for advertising or model training.
9. Service availability
We strive for high availability but:
- Planned maintenance and unexpected outages may occur
- Third-party dependencies (Apple, Cloudflare, Anthropic, etc.) may cause downtime
- The App is provided “as is”; we do not warrant that it will be uninterrupted, error-free, or fit for a particular purpose.
10. Limitation of liability
To the maximum extent permitted by law:
- The developer is not liable for indirect, incidental, special, or punitive damages.
- Total aggregate liability is capped at the subscription fees you paid in the 12 months prior to the claim.
- Loss of data, business, or profits is excluded.
These limits do not affect your statutory consumer rights under your local law (e.g., EU consumer law, UK Consumer Rights Act 2015, Türkiye Tüketici Kanunu).
11. Account deletion and termination
- You may delete your account any time in-app (see Privacy Policy §5).
- We may suspend or terminate your account for breach of these Terms.
- After deletion, your data is handled per Privacy Policy §4 retention rules.
12. Changes to these Terms
We will notify you of material changes via in-app notice and email at least 30 days in advance. If you object, you may delete your account.
13. Governing law and disputes
- These Terms are governed by the laws of the Republic of Türkiye.
- For consumer disputes, the Consumer Arbitration Boards and Consumer Courts of Türkiye have jurisdiction.
- For all other disputes, the courts and enforcement offices of Istanbul (Çağlayan), Türkiye have exclusive jurisdiction, except where mandatory consumer protection law in your country of residence requires otherwise.
